The Basics

What Does Compliance Mean After Approval?

It means monitoring your own product while it is on sale. It means keeping the certificate behind it alive. And it means being able to act within hours if an authority finds a problem. Approval is a starting line.

Two federal laws carry most of it. Federal Law No. 10 of 2018 on Product Safety sets the duties and the penalties. The Consumer Protection Law adds recall obligations that reach further than most suppliers expect.

A third instrument changed the pace. Cabinet Resolution No. 107 of 2026 came into force on 13 August 2026 and turned an open-ended obligation into deadlines counted in hours.

The Clock

How Long Do You Have After a Recall Notice?

Twenty-four hours to clear the market and forty-eight to publish. Those deadlines took effect on 13 August 2026, and they are not negotiable once the notice lands.

Cabinet Resolution No. 107 of 2026 sets out inspection, seizure and recall procedures under the anti-commercial fraud law. It was issued on 13 July 2026 and took effect thirty days after publication.

From official notification you have twenty-four hours. Stop selling, pull the goods from every shelf and warehouse in the country, notify your own supply chain, and give the authorities proof it is done.

Forty-eight hours covers publication of the recall in Arabic and English. Miss the first deadline and the Ministry carries out the recall itself within the next forty-eight hours, and bills you for it.

  • Stop selling the goods immediately
  • Clear every shelf and warehouse nationally
  • Notify your own supply chain
  • Hand proof of the recall to the authority
  • Publish in Arabic and English within 48 hours
  • File a written report within five working days

Tighter for real risk

Where a product poses a genuine health, safety or environmental risk, reporting indicates the timeline tightens further. Build the process beforehand.

Two Actions

Is a Withdrawal the Same as a Recall?

No. The law defines them separately and they describe different situations. A withdrawal is any procedure aimed at preventing an unsafe product entering the market. A recall is retrieving it from the consumer after it has already been supplied.

The distinction matters commercially as well as legally. A withdrawal stops stock moving. A recall reaches into households, which means tracing buyers, publishing notices and handling returns, repairs or refunds one at a time.

Which one applies is not your decision alone. Where a defect has reached consumers, the obligation moves from holding stock back to actively getting it returned, and the cost profile changes with it.

What Can You Be Penalised For?

Four acts carry imprisonment and a fine of between AED 100,000 and AED 1,000,000 under the product safety law. Three of them are failures to act rather than failures to comply.

Selling Before Clearance

  • Placing a product before a requested risk report is filed
  • Or after filing but before the Ministry accepts it
  • Submission is not the same as acceptance

Refusing to Cooperate

  • Declining to work with the Ministry on an unsafe product
  • Slow responses read as obstruction under pressure
  • One named contact avoids this entirely

Not Monitoring Your Product

  • The supplier must monitor safety while goods are on sale
  • This is an active duty, not a passive one
  • Complaints and incidents need recording

Ignoring a Withdrawal Decision

  • Failing to implement a withdrawal within the period set
  • Or failing to recall the product when required
  • Where goods are seized or destroyed, you pay the costs

When Does Each Approval Expire?

Renewal cycles across the regimes, so nothing lapses unnoticed.

Approval
Cycle and what to watch
ECAS certificate of conformity
One year, renewed annually. The shortest cycle most importers hold
Emirates Quality Mark
Three years, with factory surveillance continuing across the term
Food contact materials certificate
One year, with the renewal window opening two months before expiry
TDRA type approval
Typically three years, and the device must remain unmodified
Medical device authorisation
Five years from committee approval, renewed ahead of expiry
Pharmaceutical registration
Five years from approval, with renewal filed ninety days before
Pet food approval
A five-year cycle, with the ministry raising renewal a month early
Import permits
Per consignment rather than per product. Some run only thirty days
When It Happens

What to Do When a Defect Is Found

The first hours decide how this goes Everything below is easier if it was written down before you needed it.

Hour 0

Stop Supply

Halt sales and shipments of the affected batch before anything else is decided.

Hour 0

Notify the Authority

Report on discovery. The notification names a responsible individual, with a company behind them.

Hours 0-24

Clear the Market

Pull stock from every shelf and warehouse nationally, and tell your own supply chain.

Hours 0-24

Evidence the Withdrawal

Provide proof to the authority that the goods have actually been removed.

Hours 24-48

Publish the Notice

Issue the recall publicly in Arabic and English, including how consumers obtain a refund.

Days 1-5

Remedy the Consumer

Repair, replace or refund, and keep a record of every unit accounted for.

Day 5

File the Written Report

Submit the report within five working days of the recall procedures beginning.

Who Carries It

Who Is Liable as a Supplier in the UAE?

More parties than most expect. The obligations attach to whoever places a product on the market, which pulls in manufacturers, importers, distributors and retailers rather than resting with the factory abroad.

Online sellers are explicitly included. The consumer protection rules reach e-commerce providers, and that covers products third parties sell through their platform. A marketplace cannot treat listings as someone else's problem.

  • Manufacturers producing for the UAE market
  • Importers bringing regulated goods into the country
  • Distributors supplying retail and trade
  • Retailers selling to consumers directly
  • E-commerce platforms hosting third-party sellers

Worth knowing: The recall duty is triggered by a defect that would harm a consumer, and the executive regulation extends it to defects affecting a product's efficiency or effectiveness. That is a wider trigger than a pure safety test.

Where to Report

Which Authority Do You Report To?

It depends on what kind of problem you have found. Reporting to the wrong one wastes hours you do not have once a clock is running.

Records

What Records Should You Keep for Compliance?

Two sets. One proves the product was compliant when it was placed on the market. The other proves you were watching it afterwards, which is the part most businesses cannot produce on request.

Proof of Compliance

  • Current certificates for every product line
  • Test reports and the standards they cover
  • Declarations of conformity from manufacturers
  • Label artwork as approved and as printed
  • Import permits held against consignments

Proof of Monitoring

  • A complaint log with dates and outcomes
  • Records of incidents, injuries and near misses
  • Batch and traceability data by consignment
  • Distribution records showing where stock went
  • Any previous recall or withdrawal actions
  • A named person responsible for compliance

The second stack is the one that decides how a recall goes. Without distribution and batch records you cannot tell an authority where the product went. A targeted withdrawal then becomes a national one, and the cost rises with it.

The Function

What Does Good Compliance Look Like?

Six things, none of them expensive to set up and all of them difficult to assemble under pressure. A recall notice is the wrong moment to discover who in your business is supposed to answer it.

One Named Owner

A person, not a department. Reporting requires a named individual with a UAE address standing behind it.

A Live Certificate Register

Every product, its approval, its expiry date and who holds it. Reviewed monthly rather than annually.

Traceability by Batch

The ability to say which batches went where. It decides whether a recall is targeted or national.

A Complaint Route

Somewhere for problems to land and be logged, so patterns are visible before an authority spots them.

A Written Recall Plan

Who calls whom, who signs off, who drafts the notice. Written before the clock starts, not during.

Bilingual Notice Templates

Arabic and English drafts prepared in advance, because forty-eight hours includes translation.

The Numbers

What Does Non-Compliance Cost?

More than the fine, and the fines are already substantial. The recurring cost of staying compliant is small against a single recall handled badly.

Product Safety

AED 100k to 1m

The range under the product safety law, alongside possible imprisonment, for the four named acts.

Recall Breaches

AED 250k to 1m

Administrative fines reported for failing to meet recall obligations under consumer protection rules.

Beyond the Fine

Open ended

Seizure and destruction costs fall on the violator, and reporting describes licenses being cancelled.

What actually drives the cost

  • Whether you can trace stock

Poor batch records turn a targeted withdrawal into a national one. This is the single biggest cost multiplier.

  • Who does the recall

Miss the deadline and the Ministry carries it out within forty-eight hours, at your expense rather than its own.

  • How fast you respond

Delay reads as non-cooperation, which is itself one of the acts the product safety law penalises.

  • Certificate lapses

An expired approval stops shipments at the border, which costs storage and delay before anyone mentions a penalty.

A note on figures

Penalty ranges here are drawn from the legislation and from legal commentary on it. Actual outcomes depend on the facts, the category and the authority involved, and courts have discretion.
